Dell Australia Ordered to Pay $6.46 Million for Misleading Discount Representations

Australia’s Federal Court has ruled that Dell Technologies Inc.’s local unit, Dell Australia, must pay A$10 million ($6.46 million) in penalties for providing misleading information regarding discounts for add-on computer monitors on its website.

Following a legal action initiated by the country’s competition regulator, Dell Australia was found guilty of misleading customers about prices or discounts associated with add-on monitors on its website. The Federal Court reached this decision in June.

Liza Carver, the commissioner of the Australian Competition and Consumer Commission, emphasized the significance of this outcome, stating that it conveys a robust message to businesses regarding the consequences of false pricing representations and inflated discounts under consumer law. The ruling underscores that such actions will result in substantial penalties.

The case pertains to Dell Australia’s sale of over 5,300 add-on monitors, which were marketed with exaggerated discounts, between August 2019 and December 16, 2021. In response to the court’s decision, a spokesperson for Dell Australia conveyed that the company will collaborate with affected customers to facilitate appropriate refunds along with interest. Additionally, Dell Australia expressed its commitment to enhancing pricing processes to prevent similar errors in the future.
