Supporters of the law contended that it was essential because of the fast advancements in neurotechnology, which are simplifying and making more profitable the process of scanning, analyzing, and profiting from mental data.

State representative Cathy Kipp, the one who introduced the bill, highlighted the significance of setting rules to protect the personal information of people in Colorado in the field of neurotechnology to aid in the creation of new technologies while upholding the importance of consent.

State senator Kevin Priola, another supporter of the bill, highlighted that neurotechnology is increasingly moving beyond the realms of medicine and research. He noted that in the consumer products sector, the industry is currently operating without any regulations, data protection measures, or ethical boundaries.

The Neurorights Foundation, a non-profit organization supporting the ethical progress of neurotechnology, announced that a bill in Colorado, supported by the foundation, was the inaugural one in the United States.

This week, the foundation released a report assessing the state of data privacy measures in the neurotechnology sector, noting the common absence or inadequacy of such protections.The new legislation in Colorado targets consumer products used outside of hospitals since medical privacy laws already protect neurotechnologies in clinical settings.

Big technology firms such as Meta Platforms, the parent company of Facebook and Instagram, and Elon Musk’s Neuralink, are developing technology to detect brain activity for possible commercial uses.
