Swift Networks Fined $1.2 Million in Western Australian Mining Communications Contracts

Swift Networks faced a fine of $1.2 million from the Federal Court for their involvement in bid rigging concerning mining communications contracts in Western Australia.

In February, the Australian Competition and Consumer Commission (ACCC) initiated legal action against Swift Networks, alleging an agreement between Swift Networks, DXC Connect, and DXC Technology Australia.

On September 7, the court ruled in favor of the ACCC. It found that Swift Networks had indeed entered into an agreement to submit higher bids than the DXC companies in tenders for mining villages, including those for Rio Tinto’s Western Turner project, West Angelas, and Yandicoogina operations, as well as Fortescue Metals’ Iron Bridge project.

Swift Networks admitted to engaging in cartel conduct during the legal proceedings.

Apart from the $1.2 million fine, the court also mandated that Swift Networks establish a three-year compliance program. Additionally, Swift Networks is required to cover the ACCC’s legal costs, amounting to $50,000.Swift Networks’ case serves as a reminder of the consequences of anticompetitive behavior in the business landscape.
