Optus is set to face legal action in the Federal Court due to a significant data breach that occurred in 2022. The Australian Communications and Media Authority (ACMA) initiated this court case by filing the necessary paperwork earlier this week.
The ACMA confirmed that it has taken legal steps against the telecommunications company. The legal action is taken againstthe breach occurred from September 17 to 20, 2022. Optus failed to adequately safeguard its customers’ personal information from unauthorized access, as required under the Telecommunications (Interception and Access) Act 1979.
With the matter now before the court, the ACMA stated it would not be making any further comments at this time.
Optus has acknowledged the upcoming court case and indicated plans to contest the proceedings. The company is currently unable to determine the potential penalties that might arise from this situation. Given that the issue is now under judicial review, Optus has refrained from making additional comments.
Court records show that the ACMA submitted its application on Monday. The data breach compromised the records of 9.8 million customers, exposing Optus to various investigations and legal actions, including potential class-action lawsuits.
